Fonsdar Pty Ltd (ABN 82 194 898 494) (“Fonsdar”, “we”, “us”, “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you contact us, visit our website at fonsdar.com.au, or interact with us in connection with our property development activities in Canberra, Australia.

We handle personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

2. What information we collect

We may collect the following types of personal information:

• Contact information — your name, email address, phone number, and postal address when you enquire about our properties or developments.
• Communication content — the content of emails, messages, or letters you send us.
• Tenancy and business dealings information — if you become a tenant, contractor, or counterparty in one of our developments, we collect information necessary to administer the relationship (for example, business name, ABN, trade references, banking details for payments to you, insurance certificates).
• Website usage information — limited technical data your browser sends when you visit fonsdar.com.au, such as IP address and browser type. The current website does not use analytics or cookies; if this changes in a future version, this Privacy Policy will be updated accordingly.

We do not knowingly collect personal information from children, and we do not collect sensitive information (as defined in the Privacy Act 1988 (Cth)) without consent.

3. How we collect personal information

We collect personal information directly from you when you:

• Email, telephone, or write to us;
• Submit a form on our website (where available);
• Visit one of our properties or development sites;
• Enquire about, apply to lease, or transact with one of our properties.

In limited circumstances we may collect information about you from third parties such as real estate or leasing agents, business partners, or publicly available sources, where doing so is reasonably necessary for our business activities and is permitted by law.

Notification of collection. When we collect your personal information, we take reasonable steps to make you aware of (a) who we are and how to contact us; (b) the purpose for which the information is being collected; (c) the consequences of you not providing the information; and (d) the third parties (if any) to whom the information will typically be disclosed. This Privacy Policy is the standing notice for that purpose; where collection occurs in a context not covered here, we will provide the notification at the time of collection.

4. How we use personal information

We use personal information to:

• Respond to your enquiries;
• Administer leases, contracts, and other dealings;
• Manage and develop our properties;
• Maintain our records;
• Comply with legal, regulatory, and tax obligations.

We do not sell, rent, or trade personal information.

6. Storage and overseas disclosure

Fonsdar uses the following third-party providers in connection with our website and email:

• Microsoft 365 (Microsoft Corporation) — Fonsdar’s email and document services. Microsoft Corporation is headquartered in the United States; Australian customer data is stored in Microsoft’s Australian data centres, with some auxiliary processing (e.g., support and telemetry) potentially occurring in other regions. Microsoft is bound by privacy commitments consistent with the APPs.
• Vercel Inc. — Fonsdar’s website host. Vercel is headquartered in the United States and operates a global edge network including Australia. The website itself does not collect or transmit personal information through Vercel; only the static page content and your browser’s request metadata pass through it.

We take reasonable steps to ensure these providers handle personal information in accordance with the APPs.

7. Security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. Our security measures include:

• Electronic — reputable cloud providers (Microsoft 365 for email, Vercel for website hosting), encryption in transit (HTTPS for the website, TLS for email), strong account passwords, and multi-factor authentication on administrative accounts where supported;
• Operational — limiting internal access to personal information on a need-to-know basis, and regular review of who can access which records;
• Physical — paper records (where they exist) are kept in secure premises with controlled access.

No method of electronic storage or transmission is 100% secure. If a notifiable data breach (as defined under the Privacy Act 1988 (Cth)) occurs, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme.

8. Retention of personal information

We retain personal information only for as long as we need it for the purposes described in this Policy, or as required by law:

• Tenancy and contract records — retained for the duration of the relationship and for at least seven (7) years afterwards, in line with Australian taxation and business record-keeping requirements;
• General enquiries — retained for as long as is reasonably necessary to address the enquiry, then destroyed or de-identified within a reasonable period;
• Records subject to specific legal obligations — retained for the period required by the relevant law (for example, planning records under ACT planning legislation).

When personal information is no longer required and we are not legally obliged to keep it, we will take reasonable steps to destroy or de-identify it.

9. Access and correction

Under APP 12 and APP 13 you have the right to:

• Request access to the personal information we hold about you;
• Request correction of personal information that is inaccurate, out of date, incomplete, or misleading.

To make a request, please contact us using the details in section 13. We will respond within a reasonable period, generally 30 days. We may charge a reasonable cost-recovery fee for providing access; we do not charge for making a correction.

10. Direct marketing

Fonsdar does not currently engage in direct marketing. If we begin sending marketing communications, each communication will offer a clear opt-out, and you can ask us to stop sending such communications at any time using the contact details below.

11. Cookies and website analytics

The current Fonsdar website is a static informational page that does not set cookies and does not use analytics tracking. If a future version of the site introduces cookies or analytics, this Privacy Policy will be updated to describe what is collected and how to opt out.

12. Complaints

If you believe Fonsdar has breached the APPs or otherwise mishandled your personal information, please contact us first using the details below. We will investigate and respond within 30 days.
